Minnesota Marital Separation Agreement
This Marital Separation Agreement ("Agreement") is made and entered into as of __________ (the "Effective Date"), by and between ________________ ("Party One") and ________________ ("Party Two"), collectively referred to as the "Parties," who are currently married and residing in the State of Minnesota. The Parties wish to establish their mutual rights and responsibilities concerning their financial matters, property, and, if applicable, child custody and support, upon their decision to live separately.
Recitals
WHEREAS, the Parties were lawfully married on ___________, in ___________, Minnesota; and
WHEREAS, due to certain irreconcilable differences, the Parties have decided to live separately and apart from each other, intending to later pursue a dissolution of marriage under Minnesota law; and
WHEREAS, the Parties desire to resolve their marital issues without judicial intervention and wish to document the division of their marital assets, property, and, if applicable, matters pertaining to the care and custody of their children in accordance with the laws of the State of Minnesota.
Agreement
NOW, THEREFORE, in consideration of the mutual promises and agreements contained herein, the Parties agree as follows:
- Child Custody and Support. In the event that the Parties have minor children from the marriage, they agree to the following terms regarding the children's care and support, consistent with Minnesota law:

- Entire Agreement. This Agreement constitutes the entire agreement between the Parties pertaining to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings of the Parties. No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing by both Parties.
- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any principles of conflicts of law.
- Dispute Resolution. The Parties agree to engage in good faith negotiations to resolve any disputes arising out of or relating to this Agreement. If a dispute cannot be resolved through negotiation, the Parties agree to seek resolution through mediation before resorting to litigation, in accordance with Minnesota law.
