Minnesota Prenuptial Agreement
This Prenuptial Agreement (the "Agreement") is made and entered into on the ____ day of ____________, 20____ (the "Effective Date"), by and between _________________________ (the "First Party") and _________________________ (the "Second Party”)." The parties intend to marry under the laws of the State of Minnesota and wish to establish their rights and responsibilities concerning their individual and joint property. This Agreement is intended to be enforced under Minnesota Statutes, specifically the Minnesota Uniform Premarital Agreement Act.
Recitals
The parties disclosure to each other their current financial status, including assets, liabilities, income, and expectations of gifts and inheritances. The parties desire to establish their rights and responsibilities regarding each other's property.
Agreement
- Identification of Parties. The First Party's full legal name is ___________________________________, and the Second Party's full legal name is _____________________________________.
- Disclosure of Financial Status. Each party has fully disclosed to the other their current financial status, including but not limited to, assets, debts, income, and expectations of gifts or inheritances.
- Property.
- The property each party owns and brings into the marriage shall remain that party's separate property, free from any claim by the other. This includes but is not limited to real estate, stocks, bonds, and personal property.
- Any property acquired jointly after the marriage shall be considered joint property and will be divided according to the terms of this Agreement.
- Debts. Each party agrees to be solely responsible for the debts they bring into the marriage. Any joint debts acquired during the marriage shall be the joint responsibility of both parties.
- Amendment and Revocation. This Agreement may only be amended or revoked by a written document signed by both parties. Any amendments made to this agreement must be in writing and signed by both parties.
- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice or conflict of law provisions.
- Severability. Should any provision of this Agreement be deemed invalid or unenforceable, such provision shall be severed from this Agreement, and the validity and enforceability of the remaining provisions shall not be affected.
- Entire Agreement. This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings between the parties.
